TDS Responsibilities to the Client

Our responsibility to you can be summed up as follows: We will do everything we can to get you through this program and out of debt as rapidly as possible. That's our job.

More specifically, our responsibilities include notifying your creditors that you are on the program. Monitoring your deposits into your settlement account. Contacting you should there be any problem with those deposits or any indication that you are falling behind. Our staff are trained to work with you to find any possible way of increasing your deposits with the goal of getting you through the program faster than planned. We will review any correspondence received from creditors and send them appropriate responses. We will offer settlements on your account as you have the funds available to do so. We will respond to all reasonable settlement offers from your creditors. We will notify you by e-mail of any significant activities on your accounts. We will soon implement a system of mailing you monthly reports of activities on your accounts. We will keep the client website constantly up-to-date so you can get the latest developments, 24 hours a day, 7 days a week. We will always respond to any inquiries and requests in a prompt and professional manner. We welcome your feedback as to how we might improve our service to you.

TDS is not a law office and provides no legal services or advice to you at any time. TDS cannot prevent creditors from exercising their rights to take legal actions to collect your debt. Please do not ask our staff for legal advice. They are not permitted to give any.

We have made arrangements with a national provider of discounted legal services to provide you with legal assistance at special rates. Though TDS may at its discretion assist you in obtaining legal assistance, it is your responsibility to seek legal advice at Client's expense when needed. TDS makes no promise to provide you with legal services or counsel. TDS will cooperate with your legal counsel concerning any legal issues related to settlement of your debt. Again, it is your responsibility to ensure you have adequate legal advice or legal representation whether we assist you in obtaining it or not.

TDS may withdraw from servicing you if you fail to promptly deposit specified funds into your settlement account, fail to pay TDS' fees, if you negotiate with creditors on your own in violation of your service agreement, if you misrepresent or fail to disclose any material facts concerning your financial situation, if you act contrary to TDS' advice, if you fail to return TDS' phone calls in a timely manner, or if anything else occurs that in TDS' judgment impairs an effective relationship.
